OSAKA, Jan 24 (News On Japan) –
Two people, together with Ritsumeikan University Law School Professor Koichi Oda, who was the protection lawyer for one of many executed loss of life row inmates, have filed a lawsuit towards the federal government on the Osaka District Court in search of disclosure of paperwork associated to the execution of six former loss of life row inmates.
The plaintiffs argue that the failure to reveal a lot of the requested paperwork prevents verification of whether or not the executions had been carried out correctly. According to the lawsuit, the federal government used to publish the variety of executions in statistical information yearly, however since November 1998, it has been asserting the quantity on the day of execution. Since October 2007, it has been disclosing the names, birthdates, and prison details of the executed inmates.
Last 12 months, Professor Oda and one other particular person requested the disclosure of paperwork regarding the execution of six people, together with Shoko Asahara, whose actual title is Chizuo Matsumoto, the previous chief of the Aum Shinrikyo cult. The request was largely denied on the grounds that “public disclosure of information related to executions could hinder the administration of punishment and public safety and order.”
The plaintiffs argue that with out the disclosure of data, it’s not possible to confirm whether or not the executions, carried out by hanging as prescribed by the Penal Code, are correctly carried out, and so they declare that the federal government’s refusal to reveal the paperwork is prohibited. On January twenty third, they filed a lawsuit in search of the disclosure of those paperwork on the Osaka District Court.
Professor Oda said, “Hanging is a cruel punishment that violates Article 36 of the Constitution, which prohibits cruel punishments. It is necessary to disclose specific information about the death penalty, which takes human lives, and to have a discussion about it.” On the opposite hand, the Ministry of Justice has said, “We cannot comment as we have not received the complaint.”
